Disciplinary measures against bailiffs grounded on resolutions passed by the national union of bailiffs

Disciplinary measures against bailiffs can intervene only in circumstances where one has committed a disciplinary offense, strictly and restrictedly regulated by Article 44 of Law no. 188/2000, these measures failing to fall under completion by professional status, as this legal act is legally inferior to the ordinary law governing the profession, therefore, the bailiff’s act not to complete his studies can not be classified in any of the disciplinary offenses covered by this legal wording, and therefore solutions that can be passed in relevant cases by the Disciplinary Board can only reject the disciplinary action, either as late, premature or ungrounded, for each and any particular case.
