Considerations regarding the revocation of the decision of dismissal and execution of judgments in the matter of the reintegration into the labor market

The author has proposed in the study a review and an analysis regarding the revoking of dismissal decisions as well as the issue of work reintegration on the basis of a final and irrevocable court ruling. The institution of revocation has its foundation in the common law, therefore in civil law its regulation is proposed and in the provisions of the labour Code certain aspects of specificity are settled. The study presents the legal regime of the revocation as it is regulated in the present legal provisions, up until new legislation is adopted. In the matter of reintegration the national doctrine and case-law is analysed and certain proposals are presented regarding the applicable term for the obligation of the employee to present at the working place after its reintegration.
