Enforcement costs in the new Code of civil procedure

The enforcement costs represent a very important aspect in the second part of civil trial, because it can determine increasing values on the debtor’s charge. That is why the legislator understands to regulate in detail the enforcement costs by presenting the rule but also the exceptions and special situations.\r\nThe New civil procedure code does not answer to every aspect interesting the enforcement costs, this being the reason for the corroborate application of special laws such as Law no. 188 from 2000 and Minister of Justice Order no. 2550 from 2006.\r\nThe possibility of reducing enforcement costs, especially the executor’s fees, determines interpretations and discussions regarding the proportionality rule and the legal criterions from article 451, 2nd paragraph NCCP.
