Lease agreement, enforceable title

The new civil Code regulates the capacity of enforceable title of the lease agreement, in certain situations and circumstances, for the performance of the main obligations of the rent payment and of the asset restitution. Facilitating the lessor’s situation for the rent collection without being under the necessity of referring to the court, is conditional upon the forms provided in the Code, for the purpose of acquiring the capacity of enforceable title. The asset restitution is closely connected with the termination of the agreement, and in such situations the legislator indirectly restricts the assumptions in which the agreement serves as an enforceable title to the lessor, even if the genuine form or of the deed under private signature, registered with the tax administration, is fulfilled.
