The pursuit of earned income in the French system

This study aims at examining the procedure of the pursuit of earned income and of the similar income from the perspective of the French regulation. Thus, given that these types of revenues often represent the main means of subsistence, we shall find that the French lawmaker initiated a series of progressive restrictions, both by reference to their amount, and by reference to the number and income of the debtor’s family members who are his dependants. Moreover, based on the examination of the concrete procedure of the pursuit of these revenues, many differences may be found as compared to the procedure regulated by the Romanian Code of civil procedure, such as: the court with jurisdiction to order such a measure, the initiation of a stage of pre-conciliation, and also the exclusion of the power of the judicial bailiff and entrusting the tasks of pursuit to the chief court clerk of the court of first instance.
